The Law Center submitted the following testimony during the 2017 legislative session.  The descriptions of each bill were copied from the Capitol website.

H.B. 165

Requires board packets be made available for public inspection and provide notice of the availability of board packets. Requires boards to allow oral testimony to be presented on agenda items separately and at the time the item is first brought up for discussion at the meeting. Establishes notice and disclosure requirements for emergency meetings. Clarifies notice filing requirements, allows electronic mailing of meeting notices, and requires electronic posting of meeting notices, cancellation notices, and meeting minutes. Effective 7/1/2050. H.B. 166

 Authorizes UH to create, promote, and participate in new economic enterprises and expand workforce opportunities based on inventions and discoveries generated by or at the University.

H.B. 308

Allows county council members to transmit certain government records to other county council members under specified conditions. Effective 7/1/2050. Sunsets on 6/30/2019. (SD1)

H.B. 315

 Amends conditions under which two or more members of a board may attend an informational meeting or presentation on matters relating to official board business. Allows members of a county council to attend such meetings or presentations without limitation on the number of attendees.

H.B. 456

 Requires police departments to disclose to the Legislature the identity of an officer upon the officer’s second suspension in a five-year period or discharge. Requires disclosure under the Uniform Information Practices Act after a police officer’s second suspension in a five-year period.

H.B. 847

 Establishes the Innovation and Commercialization Initiative Program to expressly give the University of Hawaii the legal authority to create, promote, and participate in new economic enterprises and expand workforce opportunities based on inventions and discoveries generated by or at the University.

H.B. 991

 Allows the electronic mailing and posting of meeting notices; requires the posting of the meeting notice and minutes on the state or appropriate county websites; and increases public access to information before a public hearing by a board.  Effective January 1, 2018.

H.B. 1094

 Specifies certain content of Department of Hawaiian Home Lands homestead applicant and lessee files are not required to be disclosed.

H.B. 1156

 Provides express legal authority to enable the University of Hawaii to create, promote, and participate in new economic enterprises and expand workforce opportunities based on inventions and discoveries generated by or at the University.

H.B. 1329

Appropriates funds for grants to participants in application challenges so that the proof of concepts created during the challenges can be developed into prototypes suitable for local and state government. Requires matching funds. Effective 7/1/2038. (SD1)

H.B. 1518

Provides that upon request from a public agency, OIP may under certain conditions declare a person a vexatious records requester and restrict the person’s rights under the Uniform Information Practices Act. Establishes processes to appeal the declaration of a person as a vexatious records requester. Repeals on June 30, 2020. (HB1518 HD1)

S.B. 137

S.B. 153

 Allows surviving immediate family members of murder or manslaughter victims to access a copy of the closing report prepared by the investigating police department, upon the conclusion of all criminal and civil proceedings that arose from the offense.

S.B. 244

 Allows the electronic mailing and posting of meeting notices; requires the posting of the meeting notice and minutes on the state or appropriate county websites; and increases public access to information before a public hearing by a board.  Effective January 1, 2018.

S.B. 312

 Allows the electronic mailing of meeting notices; requires the posting of the notice on the State’s or appropriate county’s electronic calendar; and clarifies potential posting disputes. Adds emergency meetings to the public meeting notice requirements. Requires boards to make board packets available for public inspection and provide notice, upon request, of the availability of board packets.

S.B. 331

 Regulates the use of body-worn video cameras by law enforcement officers and body-worn video camera footage.

S.B. 421

 Establishes requirements for body-worn cameras and vehicle cameras for county police departments. Establishes policy guidelines for the use and discontinuance of use of body-worn cameras by police officers. Establishes certain restrictions on the use of body-worn cameras by on-duty police officers. Adds retention and deletion requirements for body-worn camera footage. Prohibits certain uses of body-worn camera video footage. Establishes violations of recording and retention requirements. Appropriates funds as a grant-in-aid to each county for the purchase of body-worn video cameras and law enforcement vehicle cameras; provided that no funds appropriated to a county shall be expended unless matched dollar-for-dollar by the county. Requires the county police departments to report costs of implementing and maintaining the body-worn camera and vehicle camera program to the legislature. Takes effect on 1/1/2018.

S.B. 424

 Requires police departments to disclose to the Legislature the identity of an officer upon the officer’s second suspension in a five-year period or discharge. Requires disclosure under the Uniform Information Practices Act after a police officer’s second suspension in a five-year period.

S.B. 478

Allows a member of a board to provide other members of the board any government record that is open to public inspection, subject to certain conditions. Takes effect on 1/7/2059. (SD1)

S.B. 572

 Allows the office of information practices to adopt rules that all state and county agencies subject to the Uniform Information Practices Act must follow for consistency in agency record protection responsibilities.

S.B. 960

S.B. 1034

 Exempts members of a county council from the limitation on the number of members that may attend an informational meeting or presentation on matters relating to official board business, including a meeting of another entity, legislative hearing, convention, seminar, or community meeting. Clarifies that such meetings shall be open to the public for purposes of permitted interactions.

S.B. 1084

 Amends the appointment process of certain members of the Hawaii Tourism Authority’s (Authority) Board of Directors (Board). Clarifies the Authority’s reporting and disclosure of specific information. Requires the Board to develop policies and procedures on approving expenditures of excess or carryover funds. (SB1084 HD1)

S.B. 1277

 Allows the minutes at public agency meetings to be kept by written or recorded means.
